ON THE PROTECTION OF PERSONAL DATA IN ACCORDANCE WITH

WEBSITE DISCLOSURE TEXT

 

As BMC Global Dis Ticaret Ltd., we would like to inform you in accordance with the tenth article of the Law titled "Obligation of the Data Controller to Inform" in accordance with the Personal Data Protection Law No. 6698 ("Law") published in the Official Gazette dated April 7, 2016 and numbered 296-77 in order to protect the fundamental rights and freedoms of individuals, especially the privacy of private life, in the processing of personal data and to determine the obligations of real and legal persons who process personal data. 

 

  1. Obtaining (Processing) and Method of Personal Data 

As BMC Global Dis Ticaret Ltd., we obtain and process the identity, contact, location, personal, legal transaction, customer transaction, physical space security (camera recording), visual and audio records, professional experience information of the relevant persons; During the establishment of your legal relationship with our Company and during the continuation of the said relationship, we obtain and process verbal, written or electronic media from you, third parties and legal authorities through the website, various contracts, e-mail, application forms, through any written or verbal communication channels made with our Company. 

The legal grounds that are based on this framework are; it is explicitly stipulated in the law, it is necessary for the establishment or performance of the contract, it is necessary for the fulfillment of a legal obligation, it is mandatory to process data for the establishment, exercise or protection of a right, and it is mandatory to process data for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject. 

 

  1. Purposes of Processing Personal Data 

Personal data are processed for the following purposes:

✓ Ensuring that necessary technical and administrative measures are taken for the security of data 

 

  1. Storage of Personal Data 

Your personal data will be retained for the maximum period specified in the relevant legislation or required for the purpose for which they are processed and in any case for the statutory statute of limitations. In the absence of any other justification or legal reason and in the event that the obligations arising from the contracts are eliminated, the personal data whose purpose of processing is eliminated are deleted, destroyed or anonymized.

  1. Transfer of Personal Data 

Within the framework of the above-mentioned purposes, your personal data may be shared with the relevant institutions or organizations and in particular; courts, judicial authorities and public legal entities to the extent permitted and required by the provisions of other legislation, including but not limited to the Law No. 6698 on the Protection of Personal Data, the Code of Civil Procedure. In addition, personal data are shared with real and legal persons with whom we cooperate in the event that our legal relationship with us or the relevant data processing purpose directly requires it.

  1. Rights of the Relevant Person 

As a personal data owner, if you submit your requests regarding your rights to us, you will be returned to you free of charge within thirty days at the latest, depending on the nature of your request. However, in accordance with Article 6 of the Communiqué on the Procedures and Principles of Application to the Data Controller published in the Official Gazette dated March 10, 2018, if the transaction requires an additional cost, the fee determined by the Personal Data Protection Board will be charged. - Learn whether personal data is being processed. 

- Request information if personal data has been processed, 

- Access to and request for personal data,

- To learn the purpose of processing personal data and whether they are used for their intended purpose, 

- To know the third parties to whom personal data are transferred domestically or abroad, 

- To request correction of personal data in case of incomplete or incorrect processing. 

- In the event that personal data is incomplete or incorrectly processed, to request that third parties to whom personal data is transferred be notified of the transactions regarding the correction of these and/or the deletion or destruction of my personal data, 

- In case of damage due to unlawful processing of personal data, to demand compensation for the damage, 

- Object to the occurrence of an unfavorable result by analyzing the processed data exclusively through automated systems 

- You have the right to request the destruction (deletion, destruction or anonymization) of your personal data in accordance with Article 7 of the KVKK and other legal requirements. 

You may also request that third parties to whom the data is or may be transferred be informed about your destruction request. However, by evaluating your destruction request, we will evaluate which method is appropriate according to the circumstances of the concrete case. In this context, you can always request information from us regarding the reason for the selected destruction method.

  • No statement in this Clarification Text and Privacy Policy may limit your rights guaranteed by KVKK.
  • This Clarification Text and Privacy Policy are subject to Turkish Law and shall be interpreted accordingly.
